Could the construction equipment manufactured or rebuild in Far East be sold in North America?

To avoid the creation of unnecessary barriers to trade WTO (World Trade Organization) developed principles of Conformity Assessment. American National Standards Institute (ANSI) issued the “National Conformity Assessment Principles for the United States”. This document articulates the principles for U.S. conformity assessment activities that will allow consumers, buyers, sellers, and regulators to have confidence that products on the market are equal in terms of the protection of human health, safety and the environment.

Conformity Assessment

is a process whereby construction equipment is evaluated against specified requirements. It permits governments to enforce the regulations for which they are responsible in protecting the public health and safety.
Conformity assessment may consist of any one of, some of, or all of the following: sample testing, item inspection, process evaluation, management system registration, and product certification

Certification

is a procedure by which a third party gives written assurance that a product, process, service or person conforms to specified requirements.

In U.S. Occupational Safety & Health Administration (OSHA) publishes its dictates in 29 CFR (Code of Federal Regulations, Part 1910) and can enforce them with fines, criminal charges, and plant shutdowns. ANSI - a coalition of technical, trade, and professional organizations (SAE, ASME, UL etc.) that develop standards for their respective industries.

An example of Conformity Assessment requirements could be found in “Some North American requirements for Industrial Trucks” post (December 23, 2004). Similar sets of requirements could be defined for any construction equipment.

To prove Conformity the relevant sampling, testing, inspection, certification, and registration shall be done. Often, compliance with different requirements shall be done by different third parties (UL, EPA, Professional Engineer etc.). A valid prove of Conformity shall be obtained.

Conclusion: The construction equipment manufactured or rebuild in Far East could be sold in North America if Conformity to regulations has a valid prove (Certificate).
